Terms of Service for Request
These Terms of Service govern access to and use of Request, a creator request and payment platform operated by MAD Compagnie, an Estonian company. By creating an account, submitting a request, accepting a request, making a payment, or otherwise using Request, you agree to these Terms.
1. Service Overview
Request connects users who submit paid personalized content requests ("Fans") with independent creators who may accept and fulfill those requests ("Creators"). Request provides the platform, payment flow, request tracking, delivery tools, and support workflows. Creators remain independent and are responsible for the content and services they choose to provide.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract in your country of residence. You may not use Request if you are barred from using the service under applicable law, sanctions rules, payment-network rules, or platform policy.
3. Accounts and Security
You agree to provide accurate, current, and complete information. You are responsible for keeping your account credentials secure and for all activity under your account. You must notify us promptly at support@request.cx if you suspect unauthorized access.
4. Creator Status and Obligations
Creators are independent contractors and are not employees, agents, partners, or representatives of MAD Compagnie. Creators are responsible for deciding whether to accept requests, delivering accepted requests on time, complying with applicable laws, respecting third-party rights, handling their own taxes, and completing any required payment-provider onboarding or identity checks.
5. Fan Requests
Fans must submit lawful, respectful, and accurate requests. Submitting a request does not guarantee that a Creator will accept it or deliver exactly the requested result. If a Creator rejects a request, fails to deliver within the applicable deadline, or the request expires according to the product flow, the payment flow is handled according to the Refund and Cancellation Policy.
6. Payments, Fees, and Payouts
Payments are processed by third-party payment providers, including Stripe. Request may charge platform, service, and payment processing fees. Payouts to Creators may be delayed, suspended, or refused if required by law, payment-provider rules, risk checks, fraud prevention, chargebacks, incomplete onboarding, incorrect payout details, or suspected violations of these Terms.
7. Prohibited Content and Conduct
Request is a non-NSFW platform. You must not request, upload, deliver, promote, or sell:
- sexually explicit, pornographic, nude, erotic, fetish, or other NSFW content;
- content involving minors in any sexual, exploitative, unsafe, or suggestive context;
- illegal, hateful, harassing, defamatory, threatening, violent, or extremist content;
- content that infringes copyright, trademarks, privacy, publicity, or image rights;
- impersonation, scams, fraud, malware, spam, or deceptive activity;
- requests or deliveries that violate sanctions, export, consumer, payment, or data laws.
We may remove content, cancel requests, withhold payouts, restrict features, suspend accounts, report illegal activity, and cooperate with payment providers or authorities where required or appropriate.
8. User Content and Licenses
You retain ownership of content you submit or deliver through Request. You grant Request a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and otherwise use that content as needed to operate, secure, moderate, support, and improve the service. Creators grant Fans the rights expressly included in the accepted request or delivery. Unless agreed otherwise, Fans may use delivered content for personal, non-commercial purposes only.
9. Intellectual Property
Request, including its software, interfaces, trademarks, designs, text, graphics, and platform content, is owned by MAD Compagnie or its licensors. You may not copy, modify, reverse engineer, scrape, resell, or exploit the platform except as permitted by these Terms or applicable law.
10. Privacy
Our Privacy Policy explains how we collect, use, store, and share personal data. By using Request, you acknowledge that you have read the Privacy Policy.
11. Suspension and Termination
We may suspend or terminate access to Request, remove content, cancel requests, or restrict payouts if we believe there is a violation of these Terms, a legal or payment risk, fraud, abuse, security concerns, or a request from a payment provider or authority. You may stop using Request at any time. Provisions that by their nature should survive termination will remain in effect.
12. Disclaimers
Request is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, specific creator performance, user earnings, request acceptance, or that delivered content will meet a Fan's subjective expectations.
13. Limitation of Liability
To the maximum extent permitted by law, MAD Compagnie and its officers, employees, contractors, affiliates, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities. Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Indemnity
You agree to indemnify and hold harmless MAD Compagnie from claims, losses, liabilities, damages, costs, and expenses arising from your use of Request, your content, your requests or deliveries, your breach of these Terms, or your violation of law or third-party rights.
15. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on Request with a new effective date. If changes are material, we may provide additional notice. Your continued use of Request after changes become effective means you accept the updated Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of Estonia, without regard to conflict-of-law rules, subject to any mandatory consumer protection rights that apply in your country of residence. Courts in Estonia will have jurisdiction except where mandatory law gives you the right to bring claims elsewhere.
